Divorce, division of assets, alimony, custody and access rights

Divorce usually changes your life in a big way, especially if there are kids involved. It can be just as tricky when you split up with your partner. You'll probably ask yourself the same questions: Who gets custody of the kids? Where will they live? Who gets to see them and how often? How much child support will be needed?

In addition to the question of fault and post-marital maintenance, another important issue in divorce is the right to division of property: What happens to my savings, my assets or my investments in the joint home? Who will live in the marital home in the future?

Inheritance Law

That is my last will and testament! It seems so simple, yet this final wish has great potential for dispute. The legally compliant drafting of a last will and testament (e.g. a will), taking into account the right to a compulsory portion, is the first step towards avoiding disputes between heirs as far as possible.

Our team will ensure that your will is drafted in accordance with the law and advise you on other decisions that need to be made during your lifetime, such as transferring your house to your children. We will draw up the necessary gift and/or transfer agreements and any related declarations of renunciation of inheritance and compulsory portions. Our team also draws up powers of attorney and living wills. 

We are also happy to advise you on succession planning in your company and the drafting of inheritance provisions under company law, again taking into account any compulsory inheritance claims. In the event of inheritance disputes, our lawyers will represent you throughout Austria in enforcing and securing your claims.
